Participation Release

Effective Date: January 14, 2024

HOLD HARMLESS AGREEMENT

Upon registering for with intent to participation in, up to and including the completion of any such participation defined as a service, activity, class, training, workshop, party, event or podcast [Event], whether it takes place in person at a location or virtually at custom chosen location, to the fullest extent permitted by applicable law, I agree to hold harmless Kathleen Boldt and her agents, associates, assistants from all liabilities, without limitation for losses, claims, judgments, suits, fines, penalties, demands or expenses that may result from my participation in the said EVENT.

WAIVER AND RELEASE OF LIABILITY

I am participating voluntarily and entirely my own risk. I am aware of the risks associated with my participation in this EVENT, which may include but are not limited to: physical or psychological injury, pain, suffering, illness, disfigurement, temporary or permanent disability (including paralysis), economic, emotional loss, or death. I understand that these outcomes my arise out of my own or others’ negligence, or from conditions at the location of the activity, class, lesson or service. Nonetheless I assume all related risks, both known and unknown to me, of my participation in this activity, class, lesson or service.

In consideration of the risks existing while participating in this EVENT and my desire to participate in said EVENT, and given the right to participate in the same, I hereby for myself, my heirs, my executors, administrations, assigns, or personal representatives, knowingly and voluntarily, enter into this WAIVER AND RELEASE OF LIABILITY and hereby waive any and all rights, claims or causes of action of any kind rising out of my participation in this activity, class, lesson or service, and I release and forever discharge Kathleen Boldt of Lewiston NY her affiliates, managers, members, agents, attorneys, staff, volunteers, heirs, representatives, predecessors, successors and assigns from any physical or psychological injury that I may suffer as a direct result of my participation in the aforementioned and registered activity, class, lesson or service.

I further acknowledge that Kathleen Boldt, her affiliates, managers, members, agents, attorneys, staff, volunteers, heirs, representatives, predecessors, successors and assigns are not responsible for errors, omissions, acts or failures, to act. If I should require medical care or treatment, I agree to assume all costs incurred as a result of such treatment. I am aware and I understand that I should carry my own health insurance and/or other insurances to secure my own safety and compliance with applicable law.

I hereby acknowledge that I have read carefully this WAIVER AND RELEASE of liability and agree that this release shall be governed for all purposes by the law of NY State or other jurisdiction in which this  EVENT is executed. I hereby accept that all virtual participation shall be considered under the jurisdiction and geographic location at which Kathleen Boldt has held the EVENT.

THIS WAIVER AND RELEASE OF LIABILITY SHALL REMAIN IN EFFECT FOR THE DURATION OF MY PARTICIPATION IN THE SAID activity, class, lesson or service, DURING THIS INITIAL AND ALL SUBSEQUENT EVENTS OF PARTICIPATION.

My acceptance and participation in the said EVENT demonstrates that I acknowledge, understand and accept the entirety of this document.
